TEMPLATE LICENSE: What is it and when do you need it?

Under the terms of our royalty-free image licensing, you may not "re-sell, distribute or sub-license" the images. Using our images in "templates" and thereby reselling them is a definite no-no and you cannot do it without first obtaining a template license from us. Doing so without a template license will be an infringement of our photographers' lawful copyright and is subject to severe penalties.

"Template" Defined
Suppose you have a web hosting service and you want to provide your customers with pre-made websites (including photos) that they can adapt to their own use by adding their logos. (Or, maybe you want to have a reservoir of images that your customers can choose from to place into your pre-made sites...)

Or suppose you are a printer and are going to create pre-printed postcards in quantity that can then be sold in smaller lots to customers who add their own names and messages to it.

Or perhaps you sell pre-printed, scored brochures that people can run through their laser printer, adding the details of their particular organization.

These are all "templates", and at least part of what your customers are paying for is the use of the images contained within those templates. That's why it's prohibited under the terms of our standard license: We're in the business of selling photos and we don't want to put you into that business, even if the use of the photo is only part of what your customers are purchasing from you.

How to get a template license
Easy. Simply phone any Comstock office and speak with a Customer Service Representative. The fact is that we provide many, many images for templates of all kinds. We want you to use our images in your templates and it's in our interest to work out an arrangement that makes sense for you and sense for us. That's our goal.

How much does a template license cost?
Our experience is that there are more variations on "templates" than there are fish in the ocean. That's why we'll need to tailor a price to your PARTICULAR needs. The good news is that we're quite willing to do that.

TWO APPROACHES:
We have found that our customers prefer one of two approaches when we are crafting a template license for them, depending on their situation: EITHER we provide pictures for a set fee, renewable annually, that anticipates the level of activity and sets the price accordingly, OR we establish a "per-item-sold" fee that is based on a percentage of the price you are charging your customers for the use of the template.

FACTORS WE CONSIDER:

  • How much of a contribution do our photos make to the overall value of the template to your customer? In some cases the photos are ancillary and secondary; in some cases the photos represent the primary value of the template. That will affect the cost of the template license.
     
  • Secondary Sales. In many cases, the customers who first get introduced to us via your template will then come to us to purchase other photos for other projects. The extent to which you encourage your customers to become aware of us and come to us for their other photo needs works very much in your favor when it comes to the price of your template license.
     
  • Your budgeting preference. As mentioned, Some customers purchase a comprehensive template license at the very beginning that will allow them to sell as many templates as possible, without further payment; others prefer a per-sale license. The goal of our Customer Service Representatives is to tailor a price for you that provides you with all the rights you need, doesn't charge you for rights you DON'T need, all within the context of fairness to both you and the photographers we represent.
